Not "The Republic As We Know It," that's already dead and gone, but the Republic in any sense.<br /><br />On the other hand, we have come nowhere near to exercising the totality of our legal and political options. <br /><br />For a couple of spare instances:<br /><br />Sandra Day O'Connor introduced into constitutional jurisprudence the notion that there is such a thing as a compelling public interest which ought to override individual rights. There is not. There cannot be. We need to attack that notion and dispose of it ... dispositively. ::grin::<br /><br />Also: because the Constitution is primarily perceived as a charter which limits the powers of government, it is not necessarily so. In reality, it is a concise and brilliant defense of the rights of the individual. For example, the First Amendment is the only one which nominates an actor on whom the limits of the clause are placed. There is no such object in the Second Amendment or any of the others. They are all absolute proscriptions, lain against ALL actors, public <i>or private</i>.<br /><br />Between the Declaration of Independence (Can you think of a clearer statement of Original Intent?) and the Ninth Amendment, it can be argued that we have an enumerated, protected right to Liberty. <br /><br />All of the laws which rely on distortions of the commerce clause are affronts to this right. Arguing between an enumerated right, absolutely not disparaged, and a nebulous pettifogging of the commerce clause, which is the stronger argument -- for or against the exercise of state power?<br /><br />And: private citizens seeking to SLAPP you are engaged in a conspiracy to deny you exercise of your civil rights -- in violation of 18USC241. Fight them on it.<br /><br />So fight it thus. Take it to court. Make the idea heard in the public square. It will not happen overnight. But, if you work it, it WILL get out there. It WILL resonate. It WILL win. Among the Constitutional movement's weaknesses is that too many of us are in our "declining years." Though we recognize the rumble of Juggernaut's carriage, we're far more inclined toward "riding it out" than taking up arms against it.</i><br /><br />On this, I ask why? Why are we not ready? And if there is an answer to that question, it begs the following one; at what point will there be, if ever, a good time to take up arms?<br /><br />You hinted at this in that paragraph. Our numbers are shrinking. At best we can hope for one in a hundred students who come out of government schooling to even be able to understand what is being discussed. <br /><br />At the time of this writing, I am not yet 30. The few in my generation who are like me are the last ones you will likely get. <br /><br />I am absolutely convinced, to my very bones, that if we were to reach out and grab it at this moment, with our current level of "public support," it would be impossible for us to lose. It will not be pretty, and one only needs to look at the history of asymmetrical warfare of the 20th century to understand how ugly it will be, and also to understand my conviction of our inevitable victory. One caveat though; it will likely not be the whole of what we refer to as these united States.
